I'm reaching out to discuss a recent concern regarding Name, Image, and Likeness (NIL) in our school district. Recently, a community partner approached one of our schools about a potential community partnership that involved student-athletes benefiting from their NIL rights.
NIL is a relatively new concept in amateur athletics, allowing athletes to capitalize on their name, image, or likeness. The TSSAA made significant updates to its Amateur Rule in December 2022, following extensive discussions with its members during various meetings.
Under this revised rule, student-athletes can receive compensation for instructional services and other non-performance-related activities. However, it's essential to note that any compensated activities should not imply endorsement or sponsorship by the TSSAA school (MSCS Schools). Moreover, student-athletes cannot use images or references related to their school's name, logo, accolades, or championships in ANY compensated activities.
In essence, this means that our student-athletes can explore their own NIL opportunities. Still, these must focus solely on their individual identity and not involve any association with our schools/district or its achievements. Student violations of this rule could result in a 12-month ineligibility period in the sport involved so in order to maintain integrity, schools and affiliates should refrain from actively promoting or negotiating students' involvement in compensated activities.
For further clarification on this rule, I encourage you to visit the TSSAA website, where you'll find detailed information and FAQs regarding Name, Image, and Likeness regulations. Ms. Weaver and I are also available to address any questions. Here is the link: Name, Image and Likeness and the TSSAA Amateur Rule | TSSAA . The National Federation of State High School Associations (NFHS) has also produced a free 15-minute course which gives further clarification on what is considered permissible in Tennessee and to further explain NIL: https://nfhslearn.com/courses/name-image-and-likeness
Furthermore, we are committed to exploring ways our district can support schools and student-athletes in navigating this new landscape. However, we must work closely with our legal counsel to ensure compliance with TSSAA Bylaws and other relevant regulations.
Thank you for your attention to this matter. Please don't hesitate to reach out if you require any additional information or assistance.
