Auto and General Liability Claims:

Tennessee Governmental Tort Liability Act/GTLA
(T.C.A. 29-20-101)

Memphis Shelby County Schools is governed by the Governmental Tort Liability Act (GTLA) (T.C.A. 29-20-101).This law provides the District with immunity from any claim or lawsuit concerning liability for any injury, property damage or loss unless certain circumstances exist (T.C.A. 29-20-201).

Employees SHOULD NOT make promises to individual(s) that the District will cover the cost of an injured person’s medical bills or property damage expenses while on District property or during a District sanctioned event.

If the individual is injured, all pertinent information about the incident must be put into the Risk Management Reporting System by the designated/assigned employee. Once this information is placed in the Risk Management Reporting System, Risk Management should investigate the incident and speak to all parties involved.
 

Memphis Shelby County Schools is self-insured for 3rd party bodily injury and or property damage claims as follows:

AUTO CLAIMS

Memphis Shelby County Schools owns and operates a fleet of over 500 vehicles. The District is self-insured for auto liability accidents that occur in Tennessee pursuant to the GTLA, T.C.A. 29-20-101.

For Out of State Auto the District is self-insured pursuant to the GTLA, T.C.A. 29-20-101(self-insured deductible), refer to Out of State Auto Liability Insurance.
 

GENERAL LIABILITY CLAIMS

Memphis Shelby County Schools is NOT responsible for theft or damage that may occur to an employee, student, or visitor’s personal property, including vehicle, while at school, work, or at an event.

All claims must be reported in the Risk Management Reporting System. (This includes employees, students and visitors) Once incidents are reported, Risk Management should investigate the incident and speak to all parties involved.
 

Theft, Lost, and Damaged District Property Claims

Memphis Shelby County Schools has over $3 billion dollars in fixed assets, such as computers, furniture, equipment, etcetera. When these items are lost, stolen, or damaged at a school, a report should be entered in the online Theft/Damage Report System. Risk Management will review and investigate each claim entered in this system, excluding student devices.

Student devices are reported and tracked separately in the online 1:1 Student Device Theft/Damage Report System. Student device replacement is managed by the Virtual Education Department.
